IP and Antitrust
This topic will focus on the intersection of antitrust and intellectual property law. We will examine current antitrust cases in high-technology fields, including computers, software, and pharmaceuticals. The topic takes a practical approach to real issues currently being litigated, including- IP an an “essential facility”; tying and bundling of IP; antitrust issues arising from standard-setting in high-tech markets; market definition and mergers in high-tech markets; “reverse payment” settlements in the pharmaceutical industry; and the conduct of dominant firms. Students and readers of this Legal Encyclopedia will be expected to write a legal brief on a topic of their choosing, based on the topic materials. A brief of sufficient length can satisfy the writing requirement.
