The topic concentrates on the notions of liberty and equality under the Constitution, often located in the Commerce Clause as well as the Fifth, Thirteenth, and Fourteenth Amendments. The aim of the topic is not limited to studying the Supreme Court's doctrinal assertions, but includes assessing the forms and politics of constitutional reasoning, with special attention given to the role of the Court in a constitutional democracy.

Constitutional Law

Although it is primarily a substantive topic, it will cover judicial review, separation of powers, federalism (the relative powers of the state and national government), equal protection (discrimination based on various categories), and fundamental rights protected through the Constitution.The topic will also focus on skill building. It will enhance students' abilities to read and synthesize cases, to formulate effective legal arguments, to engage in critical analysis, and to write law school exams.
